Who protects your works?
Your works are protected by the mere fact that you made them. This is arranged by the copyright law. You can make arrangements with everybody who wants to use your musical works. You do not need to join Buma/Stemra to secure the protection of your works.
Do you need to register?
It is advisable to have your work registered particularly if you are afraid of plagiarism. By having your work registered, it is clear that your work existed at a certain date and that you are listed as the maker of that work. This isn't a task of Buma/Stemra, but there are various possibilities:
· You can have your work registered with a number of tax offices with a Registration and Succession department
· Registration with a civil-law notary is also possible. The costs involved are usually higher.
· You can also put a recording or the lyrics of your work in an envelope, have it sealed at the post office and return it to your own address by registered post.
You then keep the sealed envelope (which then has a date stamp) in a safe place. That way your musical work is indirectly registered and dated.
What part does Buma/Stemra play?
Buma/Stemra collects royalties on behalf of the affiliated composers, songwriters and publishers for the use of their music. Buma collects royalties for performances/broadcasts of protected music, while Stemra collects in case your works are released on sound carriers (CDs, vinyl etc.) If your music is only used on the internet we advice you not to join Buma/Stemra yet, because it might cost you more than you will earn.
Affiliation with Buma/Stemra is useful only if your work is used on a certain scale. A few examples:
· There are regular live performances (=Buma),
· There are regular radio or television broadcasts on the national or commercial stations (=Buma),
· The repertoire is released by a record company (=Stemra).
Our affiliation fee is 107,50 euro for the first year and after that 62,50 euro a year. Every citizen in the world can join Buma/Stemra, but you can not be a member of two international copyright organisations for the same territorium. Please contact your organisation SIAE to quit your membership or have your contracts changed (regarding the territory).
After joining Buma/Stemra you are even able join our pilot with Creative Commons. However, the pilot covers only the territory of The Netherlands. Furthermore, it is a one year pilot, so we will be able draw any conclusions after the deadline of 23 TH August 2008.
